1. About these Terms and who we are

These Terms of Service ("Terms") govern the use of AnyMail, the mail hosting service available at anymail.tech (the "Service"). They are also the terms and conditions for providing electronic services (regulamin) required by Art. 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. The Terms are available free of charge on this page, where you can display, save and print them at any time.

The Service is provided by:

  • Michał Płatosz, an individual based in Poland ("AnyMail", "we", "us")
  • Postal address: ul. Pogodna 4C/45, 15-354 Białystok, Poland
  • Email: legal@anymail.tech

How we process personal data is described in our Privacy Policy.

2. Definitions

  • Account - your user account in the Service.
  • Consumer - a natural person who concludes the contract with us for purposes not directly related to their business or profession.
  • Sole trader with consumer rights - a natural person concluding the contract directly in connection with their business, where the contract is not of a professional nature for them, as described in Section 15.
  • Business user - anyone using the Service who is neither a consumer nor a sole trader with consumer rights (for example a company, or a sole trader acting professionally).
  • Mail server - the configuration in the Service for one of your domains, or for a subdomain of fromanymail.tech; inbox - an email address and mailbox under a mail server.
  • Plan - a paid subscription (currently Subdomain, Starter, Pro or Business) that unlocks the paid features of the Service for a billing period.
  • Offer - an individual offer for the Business plan or for renewing a domain, which we send you by email with a personal link (Section 10).
  • Your content - messages, attachments and any other data that you, people you share an inbox with, or your correspondents store or transmit through the Service.

3. Who can use AnyMail

You must be at least 18 years old and have full legal capacity to use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for it, and "you" then means that organisation as well.

4. The Service

We provide the following electronic services:

  • Account (free): registering and keeping an account, signing in, account and privacy settings, data export, the Feedback tool. Without a plan, a free account is subject to automatic deletion as described in Section 18.3.
  • Mail hosting (requires a plan): creating mail servers for domains you control or for a subdomain of fromanymail.tech (Section 8.2), guided DNS setup and verification, creating inboxes, sending, receiving, storing, searching and filtering email, drafts and Trash, sharing inboxes with other users, notifications, and access from mail apps over SMTP. Plan limits (for example the number of mail servers and inboxes) are shown on the pricing page and at checkout. On the Subdomain plan, mail servers can only use a subdomain of fromanymail.tech, not your own domain.
  • Developer features (Subdomain, Pro and Business plans): API keys for the Developer API, client libraries, and webhooks.
  • Domain registration and management (Business plan, by individual offer only): registering a domain in your name at a domain registrar, setting up your mail server and DNS records for it, and arranging its yearly renewal (Section 8.3).

To protect deliverability for all customers, each mail server has an hourly sending limit (lower during its first two weeks, and lower on subdomains of fromanymail.tech, which share one domain's reputation), messages that look like spam may be held or hidden, and a single message, its attachments and Trash are subject to the size and retention limits described in the app and in our Privacy Policy (in particular, Trash is emptied after 30 days; attachments are kept for as long as the message they belong to). As an anti-spam measure (greylisting), the first message from a sending server we have not seen before may be delayed by a few minutes, depending on when that server retries. If outgoing mail cannot be delivered permanently, a delivery-failure report (bounce) is placed in the sending inbox. Mailboxes can also be accessed with standard mail clients over IMAP (TLS-encrypted) using per-inbox app passwords; POP3 is not offered.

5. Technical requirements and risks

To use the Service you need:

  • a device with internet access;
  • a current version of a common web browser (for example Chrome, Firefox, Safari or Edge) with JavaScript, cookies and local storage enabled;
  • an email address where you can receive our messages (for account verification and service notices);
  • to attach your own domain: a domain name you own or control and the ability to edit its DNS records with your DNS provider (not needed for a subdomain of fromanymail.tech or for a domain we register for you on the Business plan);
  • optionally: a browser that supports Web Push (for push notifications), a mail app that supports SMTP with STARTTLS and password authentication (for sending from a mail app), or an HTTPS client (for the Developer API).

Using any internet service carries risks, including malware, phishing, spam, attempts to guess or steal passwords, and interception of email while it travels between other providers' servers. To reduce them, use a strong unique password, turn on two-factor authentication, keep your device and browser up to date, and be careful with links and attachments from unknown senders. The Service stores cookies, local storage entries and a service worker in your browser - see the cookie section of our Privacy Policy for what they do.

6. Your account and the contract

You create an account by filling in the registration form, ticking the box to confirm that you have read and accept these Terms and the Privacy Policy, and confirming your email address through the link we send you. The contract for the free account service is concluded when you confirm your email address, and is concluded for an indefinite period. A separate contract for a plan is concluded when you complete payment for it (see Section 10).

  • Give accurate information and keep your email address up to date - we send important notices there.
  • Keep your password, recovery codes, API keys and mail-app credentials confidential; you are responsible for activity under your account.
  • Tell us promptly at legal@anymail.tech if you suspect unauthorised access to your account.
  • We strongly recommend turning on two-factor authentication in your account settings.
  • If you forget your password, you can reset it through a link we send to your account email address. You can change your password and your email address in your account settings. Changing your password signs you out on your other devices; resetting your password or confirming a new email address signs you out everywhere, after which you sign in again. We email you about these changes, as described in the Privacy Policy.

7. Acceptable use and prohibited content

You must not provide, store or send unlawful content through the Service. In particular, you must not use the Service to:

  • send unsolicited commercial or bulk email (spam), or mail to recipients who have unsubscribed;
  • send phishing, malware, scams or other fraudulent or deceptive mail;
  • send or store content that is illegal - for example child sexual abuse material, content that incites violence or terrorism, or content that infringes intellectual property, privacy or personal rights;
  • harass, threaten or defame others;
  • attempt to access accounts, mail servers or inboxes that are not yours, or to bypass security, rate limits or sending limits;
  • send mail for a domain you do not own or control, or operate an open relay;
  • disrupt the Service or harm the shared sending reputation other customers rely on;
  • break any other applicable law.

You are responsible for complying with the law that applies to the mail you send - including data protection law, rules on unsolicited commercial communications, and consumer protection law.

8. Domains and DNS

8.1 Your own domains

You may only attach domains you own or control. Before mail for a domain is activated, you must prove control by publishing the verification record shown in the app, and you must keep the required DNS records (MX, SPF, DKIM and DMARC) correctly published. You remain responsible for your domain registration and DNS provider; if you change or remove the required records, mail for that domain may stop working.

8.2 Subdomains of fromanymail.tech

Instead of your own domain, you can create a mail server on a subdomain of fromanymail.tech that you choose (for example name@yourname.fromanymail.tech). This is available on every plan and is the only option on the Subdomain plan. The domain fromanymail.tech and all its subdomains remain ours: you receive a personal, non-transferable right to use the subdomain you chose for as long as your account exists, and you cannot transfer it to another person or provider or change it to a different name later. We publish and manage its DNS records and its DKIM signing key, so you do not need to configure anything.

  • A name must be 3-40 characters long (letters, digits and hyphens) and not already taken. We refuse names that are reserved for technical or administrative purposes, misleading, or that imitate a third party's brand, a bank, a public authority or AnyMail itself. Using a subdomain to impersonate someone else is a breach of Section 7.
  • All subdomains share the reputation of fromanymail.tech, so sending from them has a lower hourly limit than from your own domain, and sending is restricted sooner after messages are confirmed as spam. If a subdomain is used for spam, phishing or fraud, we may suspend it immediately, without a prior warning, as an urgent security measure under Section 18.2; we then send you a statement of reasons and you can appeal (Section 16).
  • When your account is deleted, your subdomain is blocked for 90 days, so that nobody else can receive mail still addressed to you; after that it may be assigned to someone else. Mail sent to it after the deletion is not delivered to you.

8.3 Domains registered for you (Business plan)

On the Business plan, we register the domain you ordered at a domain registrar in your name, using the registrant details you gave in your request, and you become the domain holder (registrant). You must give accurate and complete details and tell us about any change; the registrar's terms and the rules of the registry for that domain extension apply to you as the registrant. The name of the registrar is shown in your account once the domain is registered. We manage the registration and the domain's DNS records at the registrar on your behalf, set up your mail server for the domain, and verify it for you.

  • Renewal. A registration is paid for 12 months at a time. Before the paid period ends, we send you a renewal offer for the next 12 months; while it is unpaid, we remind you by email 30 and 7 days before the domain expires, each time with a new link (the earlier link stops working). Once you have paid, we renew the domain at the registrar; it stays registered in your name.
  • If you do not pay a renewal. We do not renew the domain. It then expires under the registrar's and registry's rules: mail for it stops working, and after any grace period those rules allow, the domain can be deleted and registered by someone else. Your Business plan itself is not cancelled automatically - you can cancel it as described in Section 10.
  • Handing the domain over. The domain is yours. You can ask us at any time at legal@anymail.tech to hand it over to you or to a provider of your choice (for example by giving you its transfer code), subject to the registry's rules - some registries do not allow a transfer shortly after registration. If your account is deleted, we keep only a handover record (the domain, your name and email address) for at most 60 days to hand the domain over to you (Section 18.3).

9. Your content

You keep all rights to your content. You give us a non-exclusive, royalty-free licence, limited to the duration of the contract and to what is necessary to provide the Service, to store, copy, transmit, process (including spam scanning) and display your content for you and the people you have shared an inbox with. We do not use your content for advertising or to train machine-learning models, and we do not sell it.

You must have the necessary rights for content you send or store. Although we take care of the data in the Service, we recommend keeping your own copies of important messages and attachments, especially before your account is closed or deleted. Our backups exist to recover the Service as a whole after data loss; we cannot use them to restore individual messages or accounts for you.

Storage allowance

Each plan includes a storage allowance for the whole account: 5 GB on the Starter and Subdomain plans, 25 GB on the Pro and Business plans. It counts the text of every message and its attachments, at their original size, in all inboxes the account owns (mail in an inbox someone has shared with you counts for its owner), including Sent, Drafts and Trash; mail stops counting once it is deleted from Trash. The app shows how much you use and warns you from 80%. When the allowance is used up, new mail addressed to your inboxes is refused with a temporary error (the sending server normally retries for several days, so it can still arrive once you free up space), mail from other AnyMail accounts is not delivered, and you cannot send mail or save new drafts until usage is below the allowance again. We never delete your mail to make room. If you move to a plan with a smaller allowance while using more than it includes, the change still takes effect; your existing mail is kept, but new mail is refused until you are back under the new allowance.

10. Plans, prices and payment

  • Prices. Current plans, prices, currency and billing period are shown on the pricing page and at checkout before you pay. Prices are final: no VAT is added, as the provider is exempt from VAT under Art. 113(1) of the Polish VAT Act. The Subdomain plan costs USD 3.99 per month and includes 1 mail server on a subdomain of fromanymail.tech, up to 10 inboxes, the Developer API and webhooks. The Business plan costs USD 14.99 per month and includes 1 mail server, up to 50 inboxes, the Developer API and webhooks; in addition, each domain is paid for in advance, 12 months at a time, at the price stated in the offer. Every plan includes the mail storage stated in the section on storage above (Starter and Subdomain 5 GB, Pro and Business 25 GB per account).
  • Business plan offers. The Business plan cannot be bought at checkout. You request it in your account, giving the registrant details and the domains you would like; you may have up to 3 open requests at a time. If we can provide it, we email you an offer with a personal link, stating the plan price, the one-time price of each domain for 12 months, the total due and the date until which the offer is valid. The link only works while you are signed in to the account the offer was made for. A newer offer replaces an earlier one, which then can no longer be paid. If you already have a plan, the Business plan replaces it as soon as your payment is confirmed; the old plan ends then and its unused part is credited to your account.
  • Payment. Payments are processed by Stripe on a secure Stripe-hosted page, using the payment methods offered there. Stripe's own terms apply to the payment itself.
  • Conclusion of the plan contract. Before paying, you tick a box to expressly ask us to start providing the plan immediately, before the 14-day withdrawal period ends, to acknowledge that if you withdraw within those 14 days you pay for the service provided until then (Section 11), and to accept these Terms - checkout is not possible without it. The contract for a plan is concluded when your payment is confirmed, and the plan is then activated straight away. Stripe sends a receipt for each payment to your email address; we keep a record of your request to start immediately - for 6 years, the general limitation period for claims (Art. 118 of the Polish Civil Code), see our Privacy Policy - and will send you a copy on request. When paying a Business plan offer or a domain renewal offer, you also tick a second box to expressly ask us to register (or renew) the domain immediately and to acknowledge that you lose your right of withdrawal for the domain once it has been registered or renewed (Section 11); we keep a record of this in the same way and for the same period. The contract for the Business plan and the domain registration, or for a domain renewal, is concluded when your payment for the offer is confirmed.
  • Renewal. Plans are paid in advance and renew automatically at the end of each billing period for the same period, at the price then in force, until you cancel. Domains on the Business plan do not renew automatically: each further year is a separate renewal offer (Section 8.3).
  • Switching to a more expensive plan (for example Starter to Pro, or Starter to Subdomain) takes effect once you confirm and pay the prorated amount shown on the payment page. Switching to a cheaper plan takes effect at the end of your current billing period - you keep your current plan until then, and you can cancel a scheduled switch before it happens.
  • Cancellation. You can cancel your plan at any time in your account settings. The plan stays active until the end of the period you have paid for and then ends; no further payments are taken. Once the plan ends, the rule in Section 18.3 applies.
  • Failed payments. If a renewal payment fails, Stripe retries it for a limited time while your plan stays usable. If payment ultimately fails, the plan ends.
  • Refunds. Amounts paid for a billing period that has already started are not refunded when you cancel or downgrade, except where you are entitled to a refund under Section 11 (withdrawal), Section 12 (non-conformity), Section 18 (where we terminate without your fault) or mandatory law.
  • Price changes apply only from your next billing period. We will tell you by email at least 30 days in advance, and you can cancel before the new price applies.

11. Right of withdrawal

If you are a consumer or a sole trader with consumer rights, you may withdraw from a contract concluded with us online within 14 days of concluding it, without giving any reason. For a plan, the period runs from the day your payment was confirmed. You can close a free account at any time anyway (Section 18).

To withdraw, send us a clear statement - for example by email to legal@anymail.tech or by post to ul. Pogodna 4C/45, 15-354 Białystok, Poland. You may use the model form below, but you do not have to. It is enough to send your statement before the 14-day period ends.

Effects of withdrawal. We will refund all payments received from you under the contract without undue delay and in any event within 14 days of receiving your statement, using the same payment method you used, unless you expressly agree otherwise; you will not incur any fees for the refund. Because, when buying a plan, you expressly asked us to start providing it before the end of the withdrawal period (Section 10), you must pay for the service provided until you told us you were withdrawing, in proportion to the total price of the plan (for example, a withdrawal 5 days into a 30-day period means paying for those 5 days); we refund the rest. Because a plan is supplied over a period, it is never fully performed within the 14 days, so your right of withdrawal is not lost by the plan having started.

Domain registration and renewal (Business plan). Registering or renewing a domain is a service that is fully performed once the registrar has registered or renewed the domain in your name. Because, when paying the offer, you expressly asked us to do this immediately and acknowledged that you would then lose your right of withdrawal for it (Section 10), the right of withdrawal for the domain part ends once the domain has been registered or renewed (Art. 38(1)(1) of the Polish Consumer Rights Act). If you withdraw before that, we refund the domain price in full. Withdrawal from the Business plan subscription itself follows the rules above: you pay only for the period until you withdrew. Withdrawing from the plan does not cancel a domain already registered in your name - it stays yours until the end of its paid period, and we hand it over to you on request (Section 8.3).

12. Conformity of the Service and your remedies

If you are a consumer or a sole trader with consumer rights, we are responsible for the Service conforming with the contract - that is, with these Terms, the plan description, and the requirements of the Polish Consumer Rights Act (Chapter 5b), which implements EU Directive 2019/770 - for the whole time we provide it. If the Service does not conform, you can:

  1. ask us to bring it into conformity. We will do so within a reasonable time from your request, free of charge and without significant inconvenience to you. We may refuse only if this is impossible or would require disproportionate costs;
  2. if we refuse or fail to bring it into conformity, if the lack of conformity continues despite our attempt, if it is so serious that it justifies an immediate price reduction or withdrawal, or if we have clearly said we will not fix it, ask for a proportionate price reduction or withdraw from the contract. You cannot withdraw if the lack of conformity is insignificant.

A price reduction or refund covers the part of the price corresponding to the period in which the Service did not conform (or, after withdrawal, the period not used), and is paid within 14 days of your statement. After withdrawal you should stop using the Service. Where we provide updates needed to keep the Service in conformity, we will inform you about them. Your statutory rights cannot be excluded or limited by these Terms.

For business users, our liability under the statutory warranty (rękojmia) is excluded to the extent permitted by law; Section 20 applies instead.

13. Complaints

You can submit a complaint (reklamacja) about the Service - including about the conformity of the Service or how we handled a request - by email to legal@anymail.tech or by post to ul. Pogodna 4C/45, 15-354 Białystok, Poland. Please include:

  • your name and the email address of your AnyMail account;
  • a description of the problem and when it occurred;
  • what you are asking for (for example, a fix, a price reduction or withdrawal).

We will reply within 14 days of receiving your complaint, by email unless you ask for a reply by post. If you are a consumer and we do not reply within that time, your complaint is considered accepted. If information is missing, we will ask you for it; this does not affect your rights.

14. Out-of-court dispute resolution

If you are a consumer and we cannot resolve a dispute with you, you may use out-of-court complaint and redress procedures. Using them is voluntary for both sides. If we reject your complaint, we will tell you whether we agree to such a procedure. You can, in particular:

  • ask your municipal or district consumer ombudsman (miejski or powiatowy rzecznik konsumentów) for free help;
  • apply to the provincial Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) for mediation, or to a permanent consumer arbitration court operating at the Trade Inspection;
  • find information and a list of entities entitled to resolve consumer disputes on the website of the Polish Office of Competition and Consumer Protection (UOKiK), uokik.gov.pl;
  • for cross-border disputes within the EU, contact the European Consumer Centre in your country (in Poland: konsument.gov.pl).

You can, of course, also go to court (Section 24).

15. Sole traders with consumer rights

If you are a natural person who concludes a contract with us directly in connection with your business, but the contract is not of a professional nature for you - which is assessed in particular by the business activity registered in the Polish business register (CEIDG) - Polish law gives you some consumer protections. In particular, you are entitled to the right of withdrawal (Section 11), the conformity rules (Section 12), and protection against unfair contract terms in the same way as a consumer. Out-of-court consumer bodies (Section 14) may not be available to you.

16. Illegal content, moderation and contact points

Points of contact

Our single point of contact for users and other recipients of the Service, and for authorities of EU Member States, the European Commission and the European Board for Digital Services (Art. 11 and 12 of the Digital Services Act, Regulation (EU) 2022/2065), is legal@anymail.tech. You can write to us in Polish or English.

Reporting illegal content

Anyone can report content stored or sent through the Service that they consider illegal - for example, a phishing campaign sent from an AnyMail address - by email to legal@anymail.tech. To help us act, please include:

  • an explanation of why you consider the content illegal;
  • where it is: for example the AnyMail sending address or domain, and the date, subject and full headers of the message;
  • your name and email address (not required if the report concerns child sexual abuse material or other offences listed in Art. 3-7 of Directive 2011/93/EU);
  • a statement that you believe in good faith that the information in your report is accurate and complete.

We confirm receipt, review reports carefully, objectively and in a timely manner, and inform you of our decision and the available ways to challenge it. If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to someone's life or safety has taken place or is likely to take place, we inform the competent authorities.

How we moderate

We do not monitor your content in general. We act on reports, on orders from authorities, and on signals from our automated spam and abuse scoring, which checks every message for typical spam and abuse patterns (described in our Privacy Policy). Automated scoring can hide a message as spam or hold it for review; holding a message, releasing it, lifting a sending restriction and any action against an account are decided by a person. Depending on the seriousness and repetition of the problem, we may: hold, hide or remove specific messages; restrict sending; suspend a mail server or inbox; or suspend or terminate the account (Section 18). We act proportionately and with due regard to the rights and legitimate interests of everyone involved, including freedom of expression.

Statement of reasons and appeal

If we restrict your content or account, we will send you a statement of reasons by email - what we restricted, the facts relied on, whether automated means were used, the legal or contractual ground, and how you can challenge the decision - unless the law prevents us or the content is deceptive high-volume commercial content. You can appeal any moderation decision, and anyone who reported content can contest our decision on their report, by writing to legal@anymail.tech within 6 months. Appeals are reviewed by a person, and we will tell you the result without undue delay. You can also use out-of-court procedures (Section 14) or go to court.

17. Processing personal data on your behalf

If you use the Service for your business or organisation and you are the controller of personal data contained in your content (for example, mail of your employees or customers), this section is our data processing agreement under Art. 28 GDPR. We will:

  • process that data only to provide the Service in line with these Terms and your settings, which are your documented instructions, or where EU or Polish law requires us to (in which case we will tell you, unless the law forbids it);
  • ensure that anyone authorised to access it is bound to confidentiality;
  • apply the security measures described in our Privacy Policy (Art. 32 GDPR);
  • use the sub-processors listed in our Privacy Policy, which you authorise; we will tell you of planned changes in advance by email and you may object, and if we cannot accommodate the objection you may terminate the contract. We impose on sub-processors the same data protection obligations;
  • help you respond to data subjects' requests and meet your obligations under Art. 32-36 GDPR, taking into account the information available to us;
  • notify you of a personal data breach affecting that data without undue delay after becoming aware of it;
  • on termination, let you export your data and then delete it as described in Section 18 and our Privacy Policy, unless the law requires us to keep it;
  • provide the information needed to demonstrate compliance with Art. 28 GDPR and allow for audits, including inspections by you or an auditor you appoint, on reasonable notice and at your cost.

You authorise the processing we need to keep the Service secure, as described in our Privacy Policy (spam and abuse detection, audit logging, administrator access for abuse and incident investigation). You are responsible for having a legal basis for the data you put into the Service. The subject matter, nature and purpose of processing is mail hosting; the categories of data and data subjects are those contained in your content; the duration is the term of the contract.

18. Suspension, termination and account deletion

18.1 By you

You can end the contract at any time, without notice and free of charge. You can cancel your plan in your account settings (it then ends at the end of the paid period), or close the account straight away with Account & privacy → Delete my account or by asking us at legal@anymail.tech. Deleting the account permanently deletes it together with all its mail servers, inboxes, messages and other data, exactly as in Section 18.3, and immediately cancels any paid plan so that no further payments are taken; the remainder of a period already paid for is refunded only in the cases listed in Section 10. Export your data first if you want to keep it (Section 18.3).

18.2 By us

We may suspend or restrict access to the Service, in whole or in part, or terminate the contract, if you seriously or repeatedly breach these Terms (in particular Sections 7 and 8), if your account poses a security risk to the Service or others, if payment for your plan finally fails, or if the law or an authority requires it. We will act proportionately and, unless there is an urgent security or legal risk, first warn you and give you a reasonable opportunity to remedy the breach. We will send you a statement of reasons (Section 16). We may also terminate the contract for other important reasons (for example, discontinuing the Service) with at least 30 days' notice by email; in that case we will refund the unused part of any prepaid plan.

18.3 Automatic deletion of accounts without an active plan

An account without an active plan is permanently deleted 2 months after its plan ended, or 2 months after registration if no plan was ever bought. A plan counts as active while its subscription is active or while a failed payment is being retried. With this deletion the contract ends.

  • We email you a warning 30, 14, 7, 3, 2 and 1 day(s) before the deletion date, and the date is shown in the app.
  • Buying or reactivating a plan before the deletion date cancels the deletion.
  • Deletion is complete and irreversible: the account and all its mail servers, domain configuration, inboxes, messages, attachments, filters, mail-app credentials, API keys, webhooks, notifications, push subscriptions, sharing grants, feedback, and Business plan requests and offers are removed, and mail to its addresses can no longer be received.
  • A subdomain of fromanymail.tech used by the account is blocked for 90 days and may then be assigned to someone else (Section 8.2).
  • A domain registered in your name on the Business plan is not deleted - it is yours. We keep a handover record of it with only your name and email address for at most 60 days, to hand the domain over to you (Section 8.3).
  • Security audit log entries are stripped of their details and removed after 365 days - except the records of a request to start a plan immediately and of a request to register or renew a domain immediately, which are kept for 6 years - Stripe keeps payment records under tax and accounting law, and copies in our encrypted backups made before the deletion expire within 14 days and are never used to bring the account back, as described in our Privacy Policy.
  • We send a confirmation email once the account has been deleted.
  • Platform administrator accounts are exempt.

Before the deletion date, use Account & privacy → Export my data to download all your data, including every message and attachment.

19. Availability and third parties

We aim to keep the Service available at all times, but there may be interruptions for maintenance, updates or reasons beyond our control. We will try to announce planned maintenance in advance. Delivery of mail also depends on systems we do not control - recipients' mail servers and spam filters, DNS, and the internet - so we cannot guarantee that a particular message will be accepted by a recipient or delivered within a particular time. This does not limit your rights under Section 12.

20. Liability

We are liable to consumers and sole traders with consumer rights in accordance with the law, and nothing in these Terms excludes or limits that liability beyond what the law allows. We are not liable for damage caused solely by your breach of these Terms, by the actions of third parties we are not responsible for, or by force majeure.

Business users: to the extent permitted by law, the Service is provided without implied warranties, we are liable only for actual damage (not lost profits), and our total liability is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. If you are a business user, you will compensate us for claims of third parties, and reasonable costs of defending them, that result from your content or from your breach of these Terms or of the law.

Nothing in these Terms excludes or limits liability for damage caused intentionally (Art. 473 § 2 of the Polish Civil Code), for personal injury, or any other liability that cannot be excluded or limited by law.

21. Intellectual property

The Service, its software, design and the AnyMail name and logo are protected by intellectual property rights. During the contract we grant you a non-exclusive, non-transferable right to use the Service for its intended purpose. Client libraries (SDKs) and other components are provided under the licences stated in them. If you send us feedback or suggestions, we may use them to improve the Service without obligation to you.

22. Analytics and aggregated data

To operate, secure and improve the Service, we analyse operational data such as request volumes, popular features and the general type of browser, operating system and device (see our Privacy Policy). From it we may create statistics that do not identify you or any other person ("aggregated data") - for example traffic volumes or performance metrics - and use them for operating, securing, supporting and improving the Service and for internal reporting, also after your use of the Service ends. We never share aggregated data in a form that identifies you. Statistics shown in the Service are provided for information and may be approximate.

23. Changes to the Service and these Terms

We may change the Service or these Terms for valid reasons: changes in the law or in decisions of authorities; security, abuse prevention or technical reasons; changes in our payment or hosting providers; or adding, changing or removing features. A change of the Service will not cost you anything extra.

We will inform you of changes to these Terms, and of changes of the Service that negatively affect you more than insignificantly, by email at least 30 days before they take effect (or earlier if the law requires a faster change), explaining what changes. If you do not agree, you can terminate the contract free of charge before the change takes effect - or, for a change of the Service that significantly and negatively affects your access to it, within 30 days of the change - and we will refund the unused part of any prepaid plan. Changes do not apply to plan periods already paid for unless they are in your favour or required by law.

24. Governing law and courts

These Terms are governed by Polish law. If you are a consumer habitually resident in another EU country, you also keep the protection of the mandatory provisions of the law of that country. Consumers may bring proceedings in the courts of the country where they live or in Poland, and can only be sued in the country where they live. Disputes with business users are resolved by the court with jurisdiction over our place of residence.

25. General provisions

If any provision of these Terms is found invalid, the remaining provisions remain in force. Our failure to enforce a provision is not a waiver. You may not transfer your rights under the contract without our consent.

These Terms are published in Polish and in English (wersja polska), and both versions have the same content. The Polish version is binding, in particular for consumers whose habitual residence is in Poland; the English version is provided for convenience. In case of any discrepancy between them, the Polish version prevails, but this does not limit the rights of consumers: an ambiguous provision is interpreted in the consumer's favour (Art. 385 § 2 of the Polish Civil Code), and a consumer keeps the protection of the mandatory law described in Section 24.
